Terms and Conditions of Sale 

1. Who we are 

These terms apply to purchases made through www.undatech.com.au (the Site). The Site is operated by UndaTech Pty Ltd (ACN 667 261 243, ABN 17 667 261 243) of E10 Union Road, Kensington NSW 2033, Australia (UndaTech, we, us, our). Orders are dispatched from Belmore, NSW. You can contact us at contact@undatech.com.au. 

2. Agreement to these terms 

By placing an order you agree to these terms, our Shipping Policy, our Returns and Refunds Policy, and our Privacy Policy. Each of those documents forms part of these terms. Please read clause 7 before you buy any UndaTech fire-resistant product. You must be at least 18 years old to place an order. 

3. Where we deliver 

We deliver to addresses within Australia only. We do not currently accept orders for delivery outside Australia. 

4. Orders and acceptance 

Your order is an offer to buy the products in your cart at the price shown. The order confirmation email we send acknowledges your order and is not acceptance of it. A contract is formed when we send you a dispatch confirmation email, and only for the products listed in that email. We may decline or cancel an order before dispatch, including where a product is unavailable, a price or description error has occurred, we cannot verify your payment or delivery details, or we reasonably suspect fraud. If we cancel an order you have paid for, we will refund the full amount to your original payment method. 

5. Prices and payment 

Prices are in Australian dollars (AUD) and include GST. Shipping charges are shown at checkout before you pay. We accept Visa, Mastercard and American Express through Shopify Payments, as well as PayPal and Afterpay. Card payments are processed by Shopify Payments, PayPal and Afterpay over an encrypted connection. We do not receive or store your full card details. Afterpay is a third party provider and your use of it is subject to Afterpay’s own terms; please pay Afterpay on time, as late fees may apply. If a product is listed at an incorrect price, we may contact you to confirm the correct price before dispatch, or cancel the order and refund you. A tax invoice is emailed with your order confirmation. 

6. Product information and sizing 

We take care to describe our products accurately. Colours may display differently on different screens. UndaShield products are designed for a close fit against the body. Please use the size guide and fit information on each product page before ordering. If you are between sizes or unsure, contact us before you buy and we will help you choose. 

7. Protective products: what has been tested 

UndaShield products are fire-resistant base layers designed to be worn under outer protective clothing. They are not a substitute for outer protective clothing or for personal protective equipment selected by your employer for the hazards of your work. 

The UndaShield fabric has been tested to ISO 15025:2000 Procedure B (limited flame spread, edge ignition) by AWTA Product Testing, a NATA accredited laboratory, issued 27 August 2025. In that test the fabric recorded no flame spread to the edges, no afterflame, no afterglow, no melting, no dripping and no flaming debris, as received and after laundering. This is a fabric test method, not a certification, and results relate to the fabric. 

Standards for arc flash and electrical work (IEC 61482-2, ASTM F1506, NFPA 70E), welding and molten metal (ISO 11611, ISO 9150, ISO 9185), radiant, convective and contact heat (ISO 6942, ISO 9151, ISO 12127), protective garments (AS/NZS ISO 11612, AS/NZS 4824, AS/NZS 4967, NFPA 2112) and chemical, blast or ballistic hazards rate the outer garment that faces the hazard, not the layer worn beneath it. UndaShield is not tested or rated to those standards and is not a substitute for the outer protective clothing your work requires. If your work involves these hazards, wear UndaShield only under the outer PPE specified for your workplace, and check with your employer or safety representative. 

No garment prevents burn injury. Fire-resistant fabric is intended to reduce burn injury risk by not melting, dripping or continuing to burn after the flame source is removed. Your safety depends on your complete protective clothing system and your workplace hazard assessment. 

Follow the care label supplied with the product. Retire and replace any garment that has been exposed to flame or heat, or that is damaged, thinned or worn through. We recommend replacing your UndaShield garment every 12 to 18 months. Like any garment worn next to the skin, repeated laundering, body oils, perspiration and daily wear change fabric and elastic over time, and how quickly that happens depends on your role, your shifts and how often the garment is worn and washed. 

8. Your rights under the Australian Consumer Law 

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. 

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law in Schedule 2, or under any other law that cannot be excluded. Our Returns and Refunds Policy explains how to make a claim, and the additional change of mind returns we offer on top of your legal rights. 

9. Liability 

Subject to clause 8 and to the extent permitted by law, we are not liable for loss or damage arising from: use of a product other than as a base layer worn under outer protective clothing; use in a hazard for which the product has not been tested (see clause 7); failure to follow the care or use instructions; alteration of the product; or normal wear and tear. To the extent permitted by law, our liability for any claim that is not covered by a consumer guarantee is limited to the price you paid for the product concerned. 

10. Promotions and discount codes 

Discount codes must be applied at checkout, cannot be applied to an order after it has been placed, cannot be exchanged for cash and cannot be combined with other offers unless we say otherwise. We may withdraw or change a promotion at any time before you place an order. Specific promotion terms are stated where the promotion is advertised. 

11. Purpose of purchase 

Our products are sold for personal use, or for use by the people within an organisation who will wear them. You must not purchase our products for the purpose of reverse engineering, copying, replicating or analysing them for the development of competing products, or for commercial resale without our written agreement. We may refuse or cancel any order we reasonably believe is placed for those purposes and will refund any amount paid. 

12. Intellectual property 

The Site and its content, including the UndaTech, UndaShield and AerForce names and logos, product designs, images and text, are owned by or licensed to UndaTech and are protected by Australian and international intellectual property laws. You may not copy, reproduce or use them without our written permission. 

13. Using the Site 

We aim to keep the Site available and accurate, but we do not guarantee uninterrupted access or that all content is free of error. We may change or remove content, products or prices at any time. Links to third party websites are provided for convenience only and we are not responsible for their content. 

14. Privacy 

We handle your personal information in accordance with our Privacy Policy. 

15. Changes to these terms 

We may update these terms from time to time. The terms that apply to your order are the terms published on the Site at the time you place the order. 

16. Events outside our control 

We are not liable for delay or failure to perform caused by events outside our reasonable control, including natural disasters, epidemic, industrial action, carrier disruption, or action of a government agency. If such an event delays your order significantly, we will tell you and you may cancel for a full refund. 

17. Title and risk 

Title to the products passes to you when we receive payment in full. Risk of loss or damage to the products passes to you when they are delivered to the address you gave us. 

18. General 

These terms, together with the documents listed in clause 2 and your order, are the entire agreement between you and us for your purchase. If any part of these terms is unenforceable, the rest continues to apply. If we do not act on a breach of these terms, we may still act on it, or on a later breach. 

19. Governing law and complaints 

These terms are governed by the laws of New South Wales, Australia. If you have a problem with an order, please contact us first at contact@undatech.com.au and we will work with you to resolve it. You may also contact NSW Fair Trading or the consumer protection agency in your state or territory, or the Australian Competition and Consumer Commission.
